Question:
To ask the Minister for Infrastructure pursuant to AQW 23538/17-22 (i) to detail to whom enforcement action would be directed against if (a) the owner of a road in dangerous disrepair was unable to be determined; or (b) if the developer of the road was no longer the owner of the road; and (ii) to outline both the meaning of the term frontager and their responsibilities for roads in disrepair.

Answer:
The Roads (NI) Order 1993 is only applicable to adopted roads and my Department does not have the authority to carry out enforcement on other private, unadopted roads. Responsibility for repairs to roads not maintained by my Department would depend on the circumstances associated with the individual case and could lie with the owner of the road or the frontager (being the owner of land adjoining the road in question).
My Department would not be in a position to comment on the legal position in relation to individual sites and private roads.
