To ask the Minister of Education whether mental capacity assessments are considered as part of the transition process for young people with a statement of special educational needs leaving school.

Revised Answer:

There is no requirement under current legislation and regulations for the Educational Psychology Service to contribute to mental capacity assessments as part of the transition process for young people with a Statement of Special Educational Needs leaving school.

Draft Regulations pertaining to the SEND Act 2016 refers to Capacity Determination, however the EA awaits the passing of these Regulations in order to progress this duty in respect of young people with SEN.
