Question: To ask the Minister of Finance whether there are plans to review or strengthen the legislative framework underpinning Non-Molestation Orders to ensure they provide meaningful protection.
Answer:
ANSWER My Department was responsible for the primary legislation governing Non-Molestation Orders (NMOs), the Family Homes and Domestic Violence (NI) Order 1998. Although there are no current plans to review the Order, following a previous review by my Department, the sentencing relating to breaches of non-molestation orders was increased from 3 to 6 months. Pursuant to AQW 24847/22-27, the Minister of Justice advised that her Department is actively working to identify where gaps in protection exist and is currently exploring how Domestic Abuse Protection Orders could be introduced with the aim of providing enhanced protection for victims. My officials continue to liaise with colleagues in other Departments who have responsibility for domestic abuse policy and will take account of other examinations of the effectiveness of NMOs, with a view to exploring this issue further with relevant colleagues.
