Question: To ask the Minister of Justice to detail what steps are being taken to (i) prevent repeated breaches of Non-Molestation Orders; and (ii) ensure that victims feel adequately safeguarded.
Answer:
I recognise the concerns that have been raised around of the operation and effectiveness of Non-Molestation Orders (NMOs), including in relation to breach of these Orders. Responsibility for policy and legislation relating to NMOs rests with the Minister of Finance, but I recognise their critical role in tackling domestic abuse and safeguarding victims. I understand that the Commissioner Designate for Victims of Crime is carrying out quantitative analysis on data relating to the application, granting and outcomes in cases of breach of NMOs in order to assess their effectiveness and identify any potential weaknesses. I await the outcome of that work and will consider its findings carefully, in conjunction with the Minister for Finance, to identify any necessary improvements. In addition, my Department is continuing to progress work to develop a viable model to support the introduction of Domestic Abuse Protection Notices and Orders (DAPNs/DAPOs) to Northern Ireland. My officials are working closely with the Police Service of Northern Ireland to ensure any new system is effective and appropriate for our legal and operational context. This work has included learning visits to pilot areas in England and engagement with frontline officers and stakeholders, with plans for further visits and for a roundtable policy workshop with interested voluntary and community sector Organisations. This evidence-led, stakeholder-informed approach underlines my commitment to strengthening protection for victims and ensuring any new measures are both operationally effective and responsive to victims’ needs.
