Question:
To ask the Minister of Justice for an update on her Department’s plans for coronial investigations into deaths abroad.

Answer:
AQO 2518 22-27 - ANSWER
Last month I published proposals for legislation which would allow coroners to investigate deaths of Northern Ireland residents which have occurred abroad. This would bring Northern Ireland into line with our neighbouring jurisdictions.

I have proposed legislation that would be family-led. Families would be able, but not required, to report a death abroad to the Coroners Service, where it is unexpected, unexplained, or in suspicious circumstances, and where they are concerned that overseas authorities have not established the cause and circumstance of the death or have doubt about the accuracy of any findings.

To ensure clarity and a consistent approach, I have also proposed that it would be for the Attorney General for Northern Ireland to decide when an inquest should be held, based on clear statutory criteria.

Amendment of primary legislation is required to implement these changes. Owing to other legislative priorities and a shortened mandate, this would have to be progressed in the next Assembly mandate, subject to the agreement of an incoming Minister and Executive.
