Question:
To ask the Minister for Infrastructure (i) for an update on the adoption of Ben Madigan Hill road, Belfast, and (ii) whether the enhanced enforcement powers, announced in September 2025, have aided the adoption process in this instance.

Answer:
The private development at Ben Madigan Hill Road, Belfast is being undertaken by the developer Kilmoon Trading Ltd.
For the development to be adopted by my Department, the Developer is required to complete the works to meet the required standards. The development is substantially complete and was placed on a 1-year maintenance period in March 2025.
Since the current maintenance period was issued, a defect to the Vehicle Restraint System has arisen. The development was inspected on 28 January 2026 and a list of defects that included remedial works to the Vehicle Restraint System were forwarded to the developer later that day.
As this is a Developer led scheme, the responsibility for addressing the outstanding matters remains with the Developer. Final adoption can be considered after the 1-year maintenance period and the completion of any remedial works necessary to bring the road to the appropriate standards. The timescales for adoption are therefore dictated by the Developer.
The enhanced enforcement powers, announced in September 2025, have not aided the adoption process in this instance due to the very recent nature of the defects. Officials are in contact with the developer and will ensure the recent defects are addressed prior to adoption.
