To ask the Minister for Infrastructure to detail the reason why (i) her Department continues to apply Code 78 restrictions to Category B and E entitlements, obtained by holders of a full manual Category B licence, notwithstanding the (a) existing Category B and E provisions, under Regulation 34(8) of the Motor Vehicles (Driving Licences) Regulations (Northern Ireland) 1996; (b) protection of existing driving entitlements, contained in Recital 5 and Article 13(2) of Directive 2006/126/EC; and (c) departmental correspondence, confirming in February 2013, that the Regulation 34(8) protection remained in force; and (ii) a corrective amendment, reportedly drafted by her Department, following the 2015 legislative change, has not been implemented.
